The U Shop Loyalty Rewards Program (the “Program”), operated by Unilever Canada Inc. (“Unilever”, “we”, “us” or “our”) is a loyalty rewards program that enables Unilever employees (“you” or “your”) to collect U Coins by purchasing eligible products (“Products”) on Unilever’s direct to consumer ecommerce website, theushop.ca (“The U Shop”).
U Coins can be redeemed by employees for certain benefits and rewards such as discounts on purchases on the U Shop or free shipping. The amount of U Coins collected by you is connected to the value of purchased Products (excluding taxes and shipping fees) and/or any other special U Coin offers provided by Unilever.
These Terms and Conditions (“Terms”) apply to your participation in the Program.
YOUR PARTICIPATION IN THE PROGRAM IS SUBJECT TO THE FOLLOWING TERMS AND ALL APPLICABLE CANADIAN LAWS. BY PARTICIPATING IN THE PROGRAM, YOU ACCEPT, WITHOUT LIMITATION OR QUALIFICATION, THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MAY NOT PARTICIPATE IN THE PROGRAM.
The Program is intended for Unilever employees based in Canada.
Please read our Unilever Privacy Notice to learn more about how we use, collect and disclose your personal information that you provide by your participation in the Program, which at all times will comply with applicable privacy laws in Canada.
What is the U Shop?
The Ushop.ca is Unilever Canada’s direct to consumer ecommerce website.
How do I collect U Coins?
You will receive 2 U Coins for every $1 you spend on the U Shop (excluding taxes and shipping fees). For example, if you spend $45 on the U Shop you will receive 90 U Coins.
You will also receive U Coins if you refer a friend to the U Shop using our refer a friend portal on the U Shop and they make a purchase on the U Shop. You will receive 10 U Coins for every $15 your friend purchases on the U Shop (excluding taxes and shipping fees).
How can I redeem U Coins?
U Coins may be redeemed for either cash discounts or free services. For example, 50 U Coins can be redeemed for a $5 discount off a U Shop purchase.
What are the benefits of the Program?
You will receive a birthday gift of 100 U Coins , and a special events multiplier where you can earn 5x the number of regular U Coins based on your purchases on the U Shop during the special event. You will also receive an automatic discount of 5% on all of your remaining purchases on the U Shop during the calendar year.
How do I participate in the Program?
In order to join the Program, just click "Login" (at the top right of the menu bar on the U Shop) then either login or Sign Up to create a FREE account. Once you're logged in, you'll be able to earn U-Coin and use those points to redeem benefits. If you are signed up with a Unilever email, you’ll gain access to the employee exclusive loyalty tier automatically within 1-3 days of sign up.
How can I redeem my U Coins?
Just click on "Rewards" tab or navigate to the U-Coin Loyalty Rewards page and you will see the list of all of the ways you can redeem your points.
Is there a minimum purchase required to redeem U Coins?
Yes. You must spend at least $15 on the U Shop, before taxes and shipping fees, in order to redeem 100 U Coins ($10 off the purchase). The dollar value of your purchases on the U Shop must always exceed the discount applies (i.e. you cannot have a negative balance on a transaction). For example, if you have 500 U Coins that you would like to redeem ($50 off purchase), you must spend at least $50 on the U Shop before taxes and shipping fees.
Who is eligible to participate in the Program?
The Program is available to Unilever employees within Canada that have an account on the U-Shop.
Are there any fees to use the Program?
No. The Program is free to use and you can cancel your participation at any time.
What brands are part of the Program?
The brands that are connected to U Shop are all of the Unilever brands that you are familiar with and brands that you trust, including, but not limited to, Hellmann’s, Dove, Axe, Tresemmé, Schmidt’s, Degree, Knorr, Love Beauty and Planet, Magnum, Breyers, Vaseline, Q-Tips, Olly, SheaMoisture, Vim, and St. Ives.
Do U Coins expire?
Unilever reserves the right to close your account without notice and your U Coins will expire if you do not make a purchase on the U Shop or redeem any U Coins at least once in a calendar year, or for any reason set out in these Terms or as allowed by applicable laws.
Are there any other restrictions with redeeming U Coins?
You will not be able to redeem U Coins on purchases containing U Shop-wide promotional discounts or other discounts, due to technical restrictions on the website.
Account Creation
Account creations are limited to one per individual . An individual is not permitted to create multiple accounts with different email addresses. Users will receive a service email when the development of the Program is completed and they can access the Program and start collecting U Coins.
Intellectual property
Unilever is the owner of or is otherwise licensed to use all parts of the Program, including all copy, software, graphics, designs and all copyrights, trademarks, service marks, trade names, logos, and other intellectual property or proprietary rights contained therein. Some materials on the service belong to third parties who have authorized Unileverto display the materials, such as certain third party licensors. By using the service, you agree not to copy, distribute, modify or make derivative works of any materials without the prior written consent of the owner of such materials. Except as expressly set forth in these Terms, no license is granted to you and no rights are conveyed by virtue of accessing or using the service. All rights not granted under these Terms are reserved by Unilever.
You may use the Program and print and download extracts from the Program for your personal non-commercial use on the following basis:
You must not misuse the Program (including hacking or “scraping”).
Unless otherwise stated, the copyright and other intellectual property rights in the Program and in material published on it (including without limitation photographs and graphical images) are owned by Unilever. These works are protected by copyright laws and treaties around the world and all rights are reserved.
You shall ensure that Unilever’s status as the author of the material on the Program is always acknowledged and referenced.
You are not allowed to use any of the materials for the Program for commercial purposes without obtaining a license from Unilever to do so.
We do not accept any unsolicited ideas to our Program from outside Unilever or, including, without limitation, suggestions about advertising or promotions, merchandising of any products, additions to our services, or changes in methods of doing business. We may already be working on or may in the future work on a similar idea. If, notwithstanding these terms and conditions, you submit an unsolicited idea to the service or otherwise to us, you understand and acknowledge that such idea is not submitted in confidence and we assume no obligation, expressed or implied, by considering it.
Third Parties
The Program may contain links to other websites not maintained by us. Other websites and Programs may also reference or link to our Program. We encourage you to be aware when you leave our service and to read the terms and conditions and privacy statements of each and every website and Program that you visit. We are not responsible for the practices or the content of such other websites and Programs.
Data we collect
We collect your name, email address and postal code to create an account. Having an account means you can come back and collect more U Coins . You can collect more coins and spend them to claim coupons. You can see the history of the rewards you earned so far. If you opt in to offers and updates from us, then we use your email address and name for this purpose too in accordance with our Privacy notice. We also collect your phone number to notify you about your coupons. We only use your phone number when you interact with the service to send you notifications. Lastly, we collect anonymous data about how you use the web Program to learn how to improve it. Check out our Privacy & Cookie notice to learn more. We review transaction receipt information to verify that you have purchased a Product, in order to calculate the associated coins.
Furthermore, by accepting these Terms, you agree to receive emails and text messages related to coupons you received or redeemed . This is required by Unilever to ensure that thyou receive all essential notifications related to their sustainable actions.
Changes
All information posted on U Shop is subject to change without notice. In addition, and to the fullest extent permitted by applicable law, these Terms may be changed at any time without prior notice. We will make such changes by posting them on U Shop . Your continued access of the Program after such changes conclusively demonstrates your acceptance of those changes.
You are responsible for protecting and keeping secure your account and any password or security questions used in connection with your account.
Subject to applicable laws, Unilever reserves the right to discontinue the Program, or any part of it, at any time on 30 days prior written notice (to be provided via a notice on the U Shop or through other communications to you, including via email or text message). If the Program is terminated, you will have up to 30 days after the effective termination date to redeem any U Coins in your account. After the expiry of the 30 day period, any coins that have not been redeemed will be forfeited subject to applicable laws.
Unilever reserves the right to sell or transfer all or part of U Shop to a related company or to a third party, to merge with another entity or to engage in any form of corporate, reorganization or financing transaction.
If any of the information you were required to submit when you registered for the U Shop changes (such as your name, mailing address, email address or phone number), you must let us know immediately and give us your current information. We are not responsible if we cannot contact you because you have not given us current, accurate information.
We reserve the right to refuse to allow you to add to your account to purchase from U Shop for any reason in our sole discretion.
We may, at any time, suspend or cancel your membership in U Shop if, in our view, you have abused any Program privilege (including, but not limited to, signing up for multiple accounts using different e-mail addresses in order to collect discount coupons), failed to follow these Terms, or made any misrepresentation to us or to any entity associated with or participating in the U Shop Program. In the event that your participation in The U Shop Loyalty Rewards Program is cancelled, all accumulated coins in your account may also be forfeited and removed from your account.
To the extent permitted by law, by participating in the U Shop Program, you (and your parent or legal guardian on your behalf, as the case may be) agree to release and discharge Unilever and its affiliates, subsidiaries and its parent company, and any other third party that may from time to time purchase from U Shop (whether as a participant or in an administrative, operational or other capacity), and our, and each of their respective officers, directors, agents, representatives, successors and assigns, from any loss, liability, claim, demand, damage or expense asserted by any person or entity relating in any way to the U Shop, your participation in the U Shop Program or the redemption and use/misuse of any item obtained through the redemption of U Coins or otherwise in connection with the U Shop.
We reserve the right to withdraw or temporarily change or suspend all or part of the U Shop in any way, in the event of a material error, omission, technical problem, computer virus or bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond our reasonable control that interferes with the proper conduct of any aspect of U Shop as set out in these Terms and Conditions. Any attempt to deliberately damage any website or to undermine the legitimate operation of the U Shop in any way (as we may determine in our sole discretion) could be a violation of criminal or civil laws and should such an attempt be made, we reserve the right to seek remedies and damages to the fullest extent permitted by law.
Our failure to exercise any of our rights, powers or remedies in these Terms or at law, or any delay in doing so, does not constitute a waiver of those rights, powers or remedies. The single or partial exercise of a right, power or remedy does not prevent its subsequent exercise or the exercise of any right, power or remedy.
ALL ASPECTS OF THE U SHOP AND PROGRAM ARE PROVIDED “AS IS” WITHOUT ANY CONDITION, REPRESENTATION OR WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
Words in the singular form shall be construed to include the plural and vice versa, unless the context otherwise requires, and the word “including” means “including but not limited to”. Any dollar amounts referenced in connection with the U Shop or these Terms are referenced in Canadian dollars.
If events beyond our control materially affect our ability to operate the Program, the Program may be suspended or terminated without notice.
Each of the provisions contained in these Terms is distinct and severable and a declaration of invalidity or unenforceability of any such provision or part thereof by a court of competent jurisdiction will not affect the validity or enforceability of any other provision of these Terms.
These Terms are governed by the laws of the province of Ontario and the federal laws applicable in Ontario, without reference to conflict of laws provisions. You agree that the sole and exclusive forum and remedy for any and all disputes and claims that cannot be resolved informally and that relate in any way to or arise out of the U Shop or the Program, shall be final and binding arbitration, except to the extent that you have in any manner infringed upon or violated or threatened to infringe upon or violate any intellectual property right of Unilever, its parent, affiliates or subsidiaries or any third party, or any privacy or publicity rights, in which case you acknowledge that arbitration is not an adequate remedy at law and that injunctive or other appropriate relief may be sought by Unilever Canada Inc., its parent, affiliates or subsidiaries or the applicable third parties.
By participating in the Program, you agree that: (i) you will contact us directly and give us the opportunity to try to resolve any and all disputes before you take any action in court, or otherwise; (ii) any and all disputes, claims and causes of action arising out of or connected with the U Shop shall be resolved individually, without resort to any form of class action; (iii) any and all claims, judgments and awards shall in no event include legal fees; and (iv) to the extent permitted by Law, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
You agree that the sole and exclusive forum and remedy for any and all disputes and claims that cannot be resolved informally and that relate in any way to or arise out of the Program, shall be final and binding arbitration, except to the extent that you have in any manner infringed upon or violated or threatened to infringe upon or violate any intellectual property right of Unilever, its parent company, affiliates or subsidiaries or any third party, or any privacy or publicity rights, in which case you acknowledge that arbitration is not an adequate remedy at law and that injunctive or other appropriate relief may be sought by Unilever, its affiliates or subsidiaries or the applicable third parties.
